terms of service

These things can be complicated, but please read this page if you are interested in working with me. These terms exist to secure the confidence of both myself and my clients.By submitting payment, you accept the terms and conditions dictated here. For the purposes of this ToS, ARTIST refers to myself (decarbry) and CLIENT refers to you as the commissioner.You must be 18 to purchase artwork from me.

wills and will-nots

What I will draw: humans, humanoids, anthros, dragons, animals, mechs, vehicles, tech, monsters, gore, violence, nudity, fan characters, fan art (with exceptions)What I will not draw: sex, fetish material, hateful, harmful, or offensive rhetoricI reserve the right to deny service at my discretion if a project makes me uncomfortable or feels dubious.

regarding reference material

I can work with nearly any form of reference material you have to explain your vision. However, I WILL NOT accept generative AI images as references in any capacity. This is a personal boundary that I refuse to cross. If you send imagery that was clearly made using genAI, I will ask you to substitute something else. If you are unwilling to find something different, I will be declining your commission.


process, payments, & updates

Process, Payments, & Updates
20% deposit up front by Stripe (preferred) or PayPal invoice. This covers the sketch! Discounts may be available as I run specials regularly!
Your sketch is completed in 3-5 days and sent for revisions/approval. Revisions will be made if necessary until approved.Upon sketch approval, the remaining 80% becomes due. Once paid in full, work resumes!You will be provided with a link to a private folder dedicated to your commission where updates will be dropped and where you will be able to see the progress of your piece.Updates are uploaded at the sketch, line, flats, shading, lighting, painting, and completed stages. I will also provide updates in-between stages when requested. Approval is required at the sketch, flats, and completion stages; as these are most important to the heart of the piece, I will not proceed until I’ve heard back. The shading, lighting, and painting stages do not require approval but revisions are welcome at all stages (please see Revisions section for limitations).Once completed and final approval is received, you will be provided with a second lower-resolution copy with a heavy watermark for public posting if desired. Your deliverables include digital files only.Surprise! Every commission (except tokens) get a free character token as well! I will ask what character you want after the main commission is complete.Your files will be available for 30 days from final approval. After that, the links will no longer be active, so please save copies of your pieces. If you ever misplace or lose your commission files, feel free to reach out and I will get you a new copy.


turnaround

My current turnaround time for single-character pieces is 30 days. If this changes because of an emergency or unforeseen circumstances, you will be alerted. I may work faster than 30 days depending on availability.


deadlines

If a deadline is required, I will do my best to complete your piece by the day before. If your deadline falls within 20 days of our first correspondence, you may be subject to a rush fee of 30% for less than 20 days, or 60% for less than 10 days.


correspondence

I work a full-time office job and freelance full-time alongside it. I work on multiple commissions at a time and your piece may not be my only focus. I will respond to correspondence as soon as possible, but responses may not be immediate depending on time of day. I work 6 days a week but may not respond to messages or emails on weekends.


usage rights and licensing

CLIENT agrees that the work provided under this agreement is for personal use ONLY and may only be reproduced for personal use in print for framing, as a printed gift, on a shirt or other one-off items for CLIENT or friends, and may be reposted online without modification and with ARTIST'S (decarbry) mark in clear view with a link to ARTIST'S (decarbry) social media or website, Philosoficate.com.CLIENT is provided with two versions: a full-resolution version with a small signature for private and personal use only, and a lower-resolution version with a heavy theft-reducing watermark. It is requested of CLIENT to only use the heavily-watermarked version whenever posting to a public space, including forums, social media, or any other online space without an expectation of privacy. This helps to protect both the ARTIST’s work and the CLIENT’s characters from unauthorized use.

copyright

The CLIENT retains ownership of original characters portrayed under these terms. The ARTIST (decarbry) retains ownership of the artwork unless full rights are purchased by the CLIENT for an additional fee.The ARTIST (decarbry) retains the right to post the artwork and WIP/progress images on social media, in art galleries both in print and digital, and as a portfolio piece, but will not offer the artwork for sale or licensing in any form to any other party. The CLIENT’s name and last initial will be included, and/or a link or tag to CLIENT’s social media unless otherwise desired.If CLIENT does not wish their commission to be posted publicly for whatever reason, this must be mentioned during the process. The ARTIST (decarbry) will be happy to delay posting as requested until after gifts are delivered or project debuts have passed. An NDA may be requested and can be provided for both parties to sign.


commercial use

The artwork provided under this agreement is not licensed for commercial use and cannot be reproduced for sale in any form. Licensing fees are available for commercial use and will run 50%-200% depending on your needs, including but not limited to method of distribution (print, web, etc), number of items produced, time frame, and geographical application. A separate contract will be drafted for work that requires licensing. Full copyright transfer is available for a 150%-300% flat fee.


nft and blockchain use

The artwork provided under this agreement is NOT licensed as an NFT or in relation to any blockchain project.


ai learning/generation

The artwork provided under this agreement is NOT to be used in AI or machine learning in any capacity.


revisions

Revisions made throughout the commission process are par for the course and expected. However, there are rare times when revisions may come with fees.Before work is completed: revisions exceeding an acceptable amount (more than 3 back-and-forths at any stage) may incur additional fees.After work is completed: minor revisions may be requested after completion of artwork in the event of mistakes made by ARTIST (decarbry). Changes requested that are contradictory to the original project outline or that were not included in the original project outline may incur an additional fee depending on each situation, up to the full commission price. Revisions requested that contradict previously-approved stages may incur an additional fee to be determined by the amount of work required.Examples of non-fee revisions: changing a shirt color from white to red, adding a ring, changing the direction of a gazeExamples of fee revisions: changing the pose after sketch approval, significant changes to hair style after sketch approval, adding a complex pattern to clothing previously unmentioned.


deliverables

CLIENT will receive full resolution digital copies of the commissioned artwork (PNG and PDF). Work files, including Photoshop files and all other types, are available only for an additional fee or separate agreement and are not included in the price of the commission.The ARTIST (decarbry) does not provide printed copies of artwork except for an extra fee, which includes material cost, labor, and shipping fees, as applicable.


refunds

Prices are flat but based on speculated work per hour. Because of this, full refunds are only available before work has started. Partial refunds may be approved in early stages of work and will only reflect what work has not been completed. Refunds are not available after work is completed unless the original project outline was not fulfilled.In the event of an emergency or development on the side of the ARTIST (decarbry) that prevents the ARTIST (decarbry) from completing the project, a full refund will be offered regardless of the work completed, as possible.


regarding creative liberty

I do my best to retain your character’s design in your commission. This includes features, outfits, and other detailings. My intent is first and foremost to preserve the identity of your character.However, every art style is different, and some things may be subject to creative liberty. This may also occur when lower-priced commission options do not allow time for extreme detailing. Some complications may have to be simplified for the structure of the illustration. These changes will be subtle and will never address a character’s most important features, and I will always discuss these with you beforehand.

Adoptable/Character Design Terms of Service

These terms are only for designs created by me originally; if you acquired a design from me that was designed by someone else, that creator’s terms apply.You may alter the design and character as you wish. Do not claim credit for designing the original design nor remove my credit from the original artwork.Purchasing a character from me does not grant you copyright of any artwork that features that character. You may not reproduce, sell, or otherwise distribute artwork that is my own. Utilizing my artwork of the character for reference or in a character gallery is fine.Do not sell the character for more than you purchased, unless it has additional artwork.You do not need to tell me if you’re rehoming the character, but do not remove my terms from the character’s profile (if on toyhou.se).Once the character is sold, it is out of my hands. Use it in whatever capacity you wish. HOWEVER: this means I wash my hands of any new content the character is used for, and I have no involvement or impact on any creation the new owner puts out. Do not come to me about questionable content using a design I no longer own.If you’re found to be breaking my ToS here, you will be blocked and blacklisted from purchasing any characters or artwork from me again, to include commission work.
